Buying Land in Turkana: Kenya's Largest County and Its Unique Tenure

Turkana County is Kenya's largest county by area, stretching from the South Sudan border in the north to the Uganda border in the west, with Lake Turkana forming the eastern boundary. The county is arid and semi-arid, home to the Turkana pastoralist community.

Oil discovery in South Lokichar, the Lake Turkana Wind Power project, tourism around the jade sea (Lake Turkana), and humanitarian/NGO activity have all created interest in Turkana.


Land Tenure: Almost Entirely Community Land

Turkana is one of Kenya's counties where the vast majority of land is community land rather than privately registered land.

The Turkana people are traditionally nomadic and semi-nomadic pastoralists. Their relationship to land is based on seasonal grazing rights and community resource management rather than individual parcel ownership. This traditional relationship was not well-captured in the colonial-era registration systems.

The Community Land Act 2016 provides the framework for formally registering community land and governing its use. Implementation in Turkana is ongoing.

For most rural Turkana land: you cannot simply buy it as you would a Kiambu plot.


What Can Be Transacted in Turkana

Urban parcels in Lodwar and other towns: The county headquarters of Lodwar and a few other urban centres have some formally registered individual land. These follow standard Kenya land transaction processes. The Lodwar Land Registry covers these.

Specific development leases: Some commercial activities (oil, energy, tourism lodges) have been structured through specific development leases or commercial arrangements with the county government and community governance structures. These are specialised transactions requiring specific legal advice.


Oil Sector Land Issues

Following oil discovery in Turkana by Tullow Oil, there has been significant interest in land near Lokichar (the oil discovery area). Some of this interest has generated fraud:

Sellers marketing privately titled land in Lokichar that does not exist. Promises of oil-sector benefit from land purchases that have no legal basis.

Any land in Turkana marketed on the basis of oil-sector upside should be treated with the highest level of skepticism.


The Registry

The Lokichar Land Registry (or sub-registry) and the Lodwar Land Registry cover Turkana County.

Turkana is not covered by Ardhisasa.


Practical Guidance

For urban Turkana land:

Commission a Litmus full field verification with a verifier who has Turkana physical presence.

For rural community land transactions:

Engage a Kenya advocate with specific experience in community land law and Turkana land governance. Confirm the community consent process has been properly followed. Understand that there is no standard quick transaction process for community land.
