Acceptance of Terms
By accessing or using Litmus's platform and services, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services. These terms apply to all users, including individual clients, institutional clients, and visitors to our website.
Description of Services
Litmus provides land verification and intelligence services for parcels in Kenya. Our services include verification reports based on analysis of public legal records, ongoing parcel monitoring, and related information products. Our services are designed to support — not replace — professional legal advice and official land searches.
Nature of Our Reports
Litmus reports are intelligence products based on analysis of publicly available information. They are not official land searches, legal opinions, or guarantees of title. Reports reflect the information available to us at the time of analysis and may not capture all risks or changes. Users should exercise independent judgment and seek appropriate professional advice before making land-related decisions.
User Responsibilities
- Provide accurate and complete parcel information when submitting verification requests.
- Use our reports and intelligence as one input in your decision-making process, not as the sole basis for any transaction.
- Do not redistribute, resell, or misrepresent Litmus reports without written authorization.
- Comply with all applicable Kenyan laws and regulations when using our services.
Limitation of Liability
Litmus provides its services on an "as-is" basis. While we take every reasonable effort to ensure the accuracy and completeness of our reports, we do not warrant that our services will be error-free or that all risks will be identified. Litmus shall not be liable for any losses, damages, or costs arising from reliance on our reports or services, except to the extent caused by our gross negligence or willful misconduct.
Intellectual Property
All content, reports, methodologies, and materials produced by Litmus are our intellectual property. Clients receive a license to use reports for their intended purpose (personal due diligence, institutional decision-making, or legal practice support) but do not acquire ownership of the underlying methodology or data structures.
Payment and Refunds
Fees for verification services are communicated at the time of request. Payment is required before report delivery unless alternative arrangements have been agreed for institutional clients. Refund requests are evaluated on a case-by-case basis. If we are unable to produce a report due to insufficient source data, we will communicate this and offer a partial refund where appropriate.
Governing Law
These terms are governed by and construed in accordance with the laws of Kenya. Any disputes arising from the use of our services shall be subject to the jurisdiction of the courts of Kenya.
Changes to Terms
We reserve the right to update these terms at any time. Material changes will be communicated through our platform or via email. Continued use of our services after changes are posted constitutes acceptance of the updated terms.
