Buying Land in Homa Bay and Migori: The Lake Victoria Southern Shore Guide

Homa Bay County extends from the Homa Bay port town along the southern shores of Lake Victoria, while Migori County lies south of Homa Bay and borders Tanzania. Both counties have fertile agricultural land, lake fishing industries, and active land markets.


The Registries

Homa Bay Land Registry: Homa Bay town. Covers Homa Bay County.

Migori Land Registry: Migori town. Covers Migori County.

Neither registry is covered by Ardhisasa. Physical attendance is required for all searches.


Lake Victoria Riparian Issues

Homa Bay and Migori share the Lake Victoria shoreline. The same NEMA riparian reserve requirements apply: development within a specified distance of the lake shore is prohibited.

For any lakeshore or near-lakeshore land, confirm:

The NEMA riparian boundary with the NEMA Western Region office. What percentage of the parcel is within the reserve. What is permitted outside the reserve.


Migori and the Tanzania Border

Migori borders Tanzania. Some areas near the border have specific land use dynamics:

Cross-border communities (Luo and Kuria communities span the border). Some land near formal and informal border crossings has commercial value not reflected in standard agricultural prices. Title documentation for land in some border areas may be less complete than in more settled areas.


Community Land and Customary Tenure

Both Homa Bay and Migori have significant Luo and Kuria community land. Confirm that any parcel has formal individual title before buying. Community land has different transaction requirements.


Agricultural Character

Both counties are predominantly agricultural. LCB consent is mandatory for all rural transactions.


Sugar Cane and Horticulture

Parts of Migori county have sugar cane and horticulture production. Factory supply agreements may be attached to some farms. Confirm any supply contract obligations before purchase.


Practical Due Diligence
