Conveyancing

The legal process of transferring land ownership from the seller to the buyer, typically handled by a qualified advocate.

Also known as: Property Transfer, Land Transfer Process
processes

Conveyancing is the formal legal process through which ownership of land is transferred from one party to another. In Kenya, this process must be handled by a qualified advocate and involves preparing sale agreements, conducting searches, paying stamp duty, and registering the transfer at the Land Registry.

Typical Steps

  1. Negotiation and agreement on terms
  2. Due diligence and official search
  3. Preparation and signing of the sale agreement
  4. Payment of the purchase price (often through an advocate's escrow account)
  5. Payment of stamp duty and other government fees
  6. Execution and registration of the transfer documents
  7. Issuance of a new title deed in the buyer's name

Always use an independent advocate — never the seller's lawyer — to protect your interests during conveyancing.
