Caveat

A formal legal notice registered against a land title to warn third parties of an existing interest or dispute.

Also known as: Land Caveat, Caveat Emptor Notice
legal

A caveat is a statutory warning lodged at the Land Registry that prevents any dealings with a parcel until the matter is resolved. It serves to protect the interests of a person who claims a right over the land but is not the registered owner.

When Caveats Are Filed

  • During ownership disputes between family members or co-owners
  • When a buyer has paid but the transfer has not yet been completed
  • When a court orders the land frozen pending litigation
  • To prevent fraudulent transfers while investigations are ongoing

A caveat will appear on an official search. If a parcel has a caveat registered against it, proceed with extreme caution and seek legal advice before transacting.
