A caveat is a statutory warning lodged at the Land Registry that prevents any dealings with a parcel until the matter is resolved. It serves to protect the interests of a person who claims a right over the land but is not the registered owner.
When Caveats Are Filed
- During ownership disputes between family members or co-owners
- When a buyer has paid but the transfer has not yet been completed
- When a court orders the land frozen pending litigation
- To prevent fraudulent transfers while investigations are ongoing
A caveat will appear on an official search. If a parcel has a caveat registered against it, proceed with extreme caution and seek legal advice before transacting.
