How to Verify a Kenya Property Agent's EARB Registration Before Working With Them
Kenya's property agent market is dominated by unregistered operators. Estimates suggest 40,000 to 50,000 individuals work as property agents in Kenya, of whom only a few hundred hold a valid practising certificate from the Estate Agents Registration Board (EARB).
An unregistered agent has no professional accountability, no regulatory oversight, and no professional indemnity insurance. If they facilitate fraud — knowingly or through negligence — your legal recourse is limited.
A registered EARB agent is subject to the Estate Agents Act, professional conduct requirements, and EARB disciplinary processes. This does not make them infallible, but it creates accountability.
The verification takes less than five minutes. Do it before engaging any agent.
What the EARB Is
The Estate Agents Registration Board (EARB) is established under the Estate Agents Act (Cap 533). The EARB:
Registers practising estate agents. Issues annual practising certificates. Sets professional conduct standards. Hears complaints against registered agents. Suspends or revokes registration for professional misconduct.
The EARB practising certificate must be renewed annually. An agent who held a certificate in 2023 but has not renewed is no longer registered.
How to Verify EARB Registration
Method 1: Ask the agent directly. Ask for their EARB certificate number and the year of issue. A legitimate registered agent will have this information immediately. Write down the number.
Method 2: Verify at the EARB. Contact the EARB to confirm the certificate is valid.

Method 3: Check the online directory. The EARB maintains a register of registered agents. Inquire at the EARB or check their published directory for your county.
What EARB Registration Does and Does Not Guarantee
Does:
- Confirms the agent has met the basic requirements for registration (minimum qualifications, application process).
- Creates a complaint mechanism if the agent acts dishonestly or negligently.
- Means the agent is subject to professional conduct standards.
Does not:
- Guarantee the agent will not make mistakes.
- Guarantee the properties they represent are legitimate.
- Replace your own independent verification of the property.
An EARB-registered agent marketing a fraudulent property may have been deceived themselves. The EARB registration tells you the agent has professional accountability, not that the property is clean.
What to Do With an Unregistered Agent
If an agent cannot produce EARB credentials, you have choices:
Decline to work with them and find a registered agent. Work with them with heightened caution, knowing your recourse is limited.
If you choose to work with an unregistered agent, the most important protection is independent verification of any property they introduce you to. A Litmus verification is particularly important when the agent's own accountability cannot be established.
The Post-POCAMLA 2025 Dimension
Under POCAMLA 2025, real estate agents are now DNFBP reporting entities with AML/CFT obligations. Registered EARB agents are expected to implement client due diligence, record-keeping, and suspicious transaction reporting.
This compliance framework should, over time, increase the professionalism and accountability of the registered segment of the Kenya property agent market.
