What is the Role of the Kenya Land Registrar?

The Land Registrar is the government official responsible for maintaining the land register for their county or sub-registry. They receive and process applications for registration, maintain the physical and digital registers, and issue title deeds.

Understanding what the Registrar can and cannot do is important for anyone dealing with title complications, registration disputes, or the need to challenge a Registrar's decision.


What the Land Registrar Does

Processes registration applications. When an advocate presents a transfer, charge, caution, or other instrument for registration, the Registrar or their staff:

Reviews the documents for completeness. Confirms stamp duty has been paid. Enters the transaction in the register. Issues the relevant certificate or deed.

Maintains the land register. The Registrar is responsible for the integrity of the register. This includes both digital records and physical files.

Issues certified copies. The Registrar can issue certified copies of title deeds, extracts from the register, and replacement title deeds where the original is lost.

Handles administrative corrections. Under Section 37 of the LRA, the Registrar can correct clerical errors in the register without court involvement.

Caution and caveat management. The Registrar receives caution applications, notifies registered proprietors of cautions, and can review applications to remove unjustified cautions under Section 71 of the LRA.


What the Land Registrar Cannot Do

Cancel a registered title without a court order.

The case of Republic v Chief Land Registrar; Meron Limited [2025] KEELC 475 confirmed this explicitly. The ELC quashed the Registrar's attempt to cancel registered titles without a court order. Only a court can cancel a registered title.

The Registrar can flag a title, annotate it, or freeze it at court direction. They cannot simply remove it.

Resolve contested ownership claims. Disputes between competing claimants for ownership of the same land are for the court, not the Registrar.

Override court orders. The Registrar must comply with valid court orders. They cannot refuse to register a transfer ordered by the court.

Determine what the "correct" ownership is. This is the court's role.


The Principal Registrar and the Chief Land Registrar

There is a hierarchy:

County Land Registrars: Responsible for their specific county's register.

The Chief Land Registrar: The national head of the land registration system, based at Ardhi House in Nairobi.

The Chief Land Registrar has supervisory functions over county registrars and can issue directions on registration practice.


When the Registrar's Decision Can Be Challenged

Under Section 78 of the LRA, a person aggrieved by the Registrar's decision can apply to the Environment and Land Court for judicial review.

Common grounds for challenge:

The Registrar acted outside their powers (cancelled a title without court order — Meron case). The Registrar failed to follow required procedures. The Registrar's decision was unreasonable.


Practical Implications for Buyers

Physical registry file review requires the Registrar's registry to be accessed. A Litmus verifier physically attending the registry is interacting with the Registrar's office staff to access the physical file.

Caution removal proceedings involve a formal application to the Registrar, with the Registrar having authority to remove unjustified cautions subject to the procedure in Section 71 LRA.

Replacement title deed applications are processed by the Registrar under Section 38 LRA.
