How to Search for Lis Pendens and Court Orders Affecting Kenya Land

This is one of the most practical skills a Kenya property buyer can have: how to physically search court registries for any active cases or orders that could affect the land you want to buy.


1. Environment and Land Court (ELC) — Case Registry

The ELC handles all land disputes. Any case about the ownership, title, boundaries, or use of the parcel will be here.

Location: ELC has stations in every county. Nairobi ELC is at Milimani Law Courts.

What to search by:

The LR or CR number of the parcel (most effective). The registered owner's full name. The seller's full name.

How to search:

Attend the ELC registry. Ask the clerk to search the cause register for any cases naming your parcel number or the registered owner. Some ELC stations have computerized registers; others require manual register review.


2. High Court Succession Division

Any succession cause (estate distribution after a death) involving the land or its registered owner.

Location: High Court Family Division at the county where the deceased lived or where the land is located.

What to search by:

The registered owner's name (if you are checking whether the owner is deceased or has succession proceedings). The deceased's name (if you know the land was recently inherited).


3. High Court Civil Division

Judgment creditor claims, commercial disputes, and other civil cases that could result in attachment orders affecting the land.

Location: High Court (Civil Division) in the county.

What to search by:

The registered owner's full name. Any company name associated with the seller.


What You Are Looking For

Active cases: Any case that is pending (not yet concluded) that names the parcel or the registered owner.

Recent judgments: Judgments in the past 3-5 years that may have resulted in orders affecting the land.

Registered lis pendens or caveats: Some courts keep a register of lis pendens notices filed. Ask the registry clerk whether such a register exists.

Attachment orders: Orders in favor of judgment creditors that have been registered in the court's records.


What a Clean Search Looks Like

After searching all three court systems:

No active cases involving the parcel. No active cases against the registered owner that could affect the land. No succession disputes active. No attachment orders.


If You Find Something

Contact a Kenya advocate immediately. They will need to review the specific case file to understand:

The nature of the proceedings. What stage the case is at. What impact the case could have on your purchase. Whether the case creates a lis pendens that would prevent you from registering a transfer.

Do not proceed with the purchase until the implications are fully understood.
